- Attention is drawn to Rule 37(v) of the Jammu and Kashmir Civil Services (Leave) Rules, 1979 (amended from time to time). This rule states that cash equivalent of leave salary can be granted to retired or deceased officials.
- The competent authority may withhold whole or part of the cash equivalent for an official who retires while under suspension or with pending disciplinary or criminal proceedings, if there is a possibility of recoverable money from the official.
- Observance of Rules:
- Despite previous instructions, it has been observed that claims are often submitted without proper scrutiny, leading to delays.
- To ensure timely processing, the following directives must be followed:
- Authorization certification that no disciplinary action is pending.
- Leave sanction order (Cash-in-Lieu) must be appended with the case.
- Proper calculation of leave salary for the retired or deceased employee in accordance with the regulations.
- Certification and Documentation:
- Retirement notification should be issued as per Rule 285 of J&K Civil Services Regulations, 1956, ideally at the start of the calendar year for officials due to retire within the next 24 to 30 months.
- Sanction should be accorded at least one month before retirement.
- The requisition of funds should be included in the monthly statement by the Drawing and Disbursing Officer (DDO).
- In cases of death, all dues should be settled within a month.
