Ban on Sale of Fuel to 2 Wheeler Riders Without Wearing Helmet

The Office of the Deputy Commissioner/District Magistrate, District Development Commissioner Kupwara has issued an important order regarding the sale of fuel to two-wheeler riders.

Background

A significant surge in road traffic accidents involving two-wheeler riders who fail to wear helmets has been observed. Such accidents often result in severe injury and fatalities due to the non-wearing of helmets. The District Administration is committed to addressing this issue in conjunction with the Police and Transport Department by enforcing traffic regulations.

Legal Framework

  • The Motor Vehicle Act of 1988 prohibits the operation of two-wheelers without wearing helmets and defines it as a serious traffic offense.
  • The Bharatiya Nagarik Suraksha Sanhita, 2023 empowers the District Magistrate to take necessary actions to ensure public safety and security.

Key Orders

In light of the above, Ayushi Sudan, IAS, District Magistrate of Kupwara, has issued the following orders, effective immediately:

  1. Ban on Sale of Fuel: No petrol pump station/filling station in District Kupwara is allowed to sell fuel to two-wheeler riders who are not wearing helmets or to minors.
  2. Installation of CCTV Cameras: All petrol stations are required to install CCTV cameras that capture clear footage of customers.
  3. Monitoring: The Executive Magistrates are authorized to review the CCTV footage and report any violations.
  4. Personal Liability: Petrol stations found selling fuel to helmetless riders or minors will be held personally liable and dealt with according to the law.
  5. Order Communication: The Tehsildars/AD Food CS & CA Kupwara must serve this order to all petrol stations and communicate the same to the District Magistrate’s Office.

Enforcement

Any violation of this order will be dealt with according to section 223 of the Bharatiya Nyaya Sanhita 2023. The order is effective from 10th July 2024.

  6. Dy. SP Traffic Rural Baramulla
  7. Assistant Director FCS & CA, Kupwara

The Kupwara District Administration seeks the cooperation of all stakeholders to ensure the safety of two-wheeler riders and reduce the rate of accidents and fatalities.
