A government order, No. 100-JK (Rev) of 2024 dated 02-08-2024, specifies the conferment of proprietary rights to the displaced persons (DPs) on the State lands allotted to them as per earlier orders dating back to 1954, 1965, 2000, and 2007. - Application Process:
- Eligible displaced persons or their legal heirs must apply to the concerned Tehsildar.
- Required documents include proof of continuous landholding since allotment and cultivation records.
- Conditions for Conferment:
- The applicant must demonstrate that the land was continuously held since the initial allotment.
- The applicant must provide an affidavit stating that there has been no encroachment on state land and all applicable heirs are included.
- Family Composition:
- The definition of the family follows the explanation in Para 2 of Cabinet Order No. 578-C of 1954.
- Land Use and Subletting:
- Land must be used for agriculture or permissible residential/agriculture allied activities.
- The allottee or heirs should not have sublet the land or created third-party interests.
- Restrictions:
- Proprietary rights won’t be conferred for lands within municipal corporation/committee limits.
- Ownership will be denied if allotment was obtained through fake/forged documents.
- Administrative Process:
- The Tehsildar will scrutinize and forward applications to the AC(R)/SDM with recommendations.
- The AC(R)/SDM will evaluate and approve the order for mutation in favor of the applicant with the Deputy Commissioner’s prior approval.
- Monitoring:
- Monthly progress reports on these mutations will be submitted to the Divisional Commissioner/Financial Commissioner, Revenue.
- Weekly camps will be conducted in villages/areas where displaced persons reside to ensure no eligible person is left out.
The Financial Commissioner, Revenue, is tasked with issuing further clarifications or guidelines for the smooth implementation of this policy.
