In a recent development, the Government of Jammu and Kashmir has passed an order concerning the case of an Engineer, Mr. Sanjay Koul, who is currently under suspension. The order emanates from the proceedings of OA No. /2023 titled Sanjay Koul Vs UT of J&K and others, after a directive was received from the Hon’ble Central Administrative Tribunal (CAT).
The tribunal’s order, dated 12th May 2023, required the Principal Secretary to the Government, Public Works (R&B) Department, Union Territory of Jammu & Kashmir, to decide on the applicant’s suspension, ensuring the applicant was provided an opportunity for a hearing. This process was to be completed within four weeks from the receipt of the tribunal’s order.
Subsequently, Mr. Sanjay Koul was called upon to present his case in person, armed with all supporting records, on 19th June 2023. He appeared before the Additional Secretary to Government, Pw(R&B) Department, J&K, at the Civil Secretariat in Jammu. During this meeting, Mr. Koul presented a detailed written statement regarding the incident.
The departmental inspection of records revealed that a complaint was filed against Mr. Koul, wherein it was alleged that he, in conspiracy with others, was involved in a demand for a bribe concerning a Medical SubCentre construction project in the Reasi district for the fiscal year 2017-2018. This complaint led to a CBI case registration and consequent judicial proceedings.
Mr. Koul was arrested in light of the FIR but was later released on bail by the Court of Special Judge Anti-Corruption (CBI Cases), Jammu, on 4th December 2021. Following his arrest, the Government placed him under suspension, and eventually, he was attached with the Chief Engineer, PW(R&B), Jammu as per the relevant orders and rules.
In addition, prosecution sanction was granted against the accused individuals, including Mr. Koul, by the General Administration Department. As directed by the Government Order, all matters regarding the review of the suspension were referred to the General Administration Department for consideration.
This case sheds light on the due process followed by the J&K Government in handling allegations of corruption within its departments, ensuring that justice and administrative procedures are properly maintained. The review of Mr. Koul’s suspension is contingent upon the outcome of the charges levelled against him, as the court proceedings continue. The Public Works Department is closely monitoring the situation, and further developments will be communicated in due course.
